So, they're work They're really responding well and working on it. That's what I did today along with assorted other crap. I found I need to send it to you. I found a project for your handyman. And? It was uh like uh a slide you see at a water park, only it was at a house. Yeah. And it was a little corgi slide. So, the corgis on the top of the slide. Aw. Little spiral. There There is a YouTube video of a dog coming down a big slide, a corgi, just flying through the air. Yep. All of them are in the pool. Taking his billboard truck to Union City, New Jersey to call out not only Mayor Brian Stack on the street, but to protest out outside of Captain Gaston's house and the Union City Board of Education. Okay. Claiming that That's a good use of funds. Yeah. He's claiming that Leroy is innocent, that Captain Gaston, at the time Lieutenant Gaston, flopped on the floor to set Leroy up with the aggravated assault charges that are still pending against him. If found convicted, he is looking at five years in the state penitentiary. Not only that, Shawn called the DA's office of Essex County to try to get them to speak about an ongoing investigation. Guess what happened? They told him nothing. They cannot speak on an ongoing investigation. In other news, Press Anything Now, aka Mark Manchild, at his antics yet again, this time at a Florida church. Oh, nice. Getting into a bit of an argument with one of the parishioners who does traffic control there. He then got into it with a woman driving by recording him, calling him an effing weirdo. And then he tried to intimidate her by saying out her license plate. He spoke to a deputy who was also on traffic detail there for the church. Then a few minutes later, the same deputy informed him that he has been trespassed from the property. In retaliation, Mark has decided to pass around fake $100 bills that are movie props that say for motion picture purposes only and telling the parishioners to donate this $100 bill to the church. I was trespassed. They won't They won't let me come on to donate. Several people took these bills and were going to the church to donate it into their collections. But they were coming back and telling him that these are fake bills. One person actually took a bill that was torn in half by one of the parishioners there to a local convenience store to get tested and it showed up as fake. He was telling people that he got the money from his bank. And in the state of Florida, knowingly passing around fake currency for actual goods and services is a crime that can get you on the eyes of the federal police. I also offered to provide the Larimer County website where you can make a discovery request, but he did not want that website written down for him. So, I've instructed him up to the second floor to request that discovery after this court date. Okay. Uh Mr. Sullivan, what are you asking the court to do today? Yep. Yep. Phil wanted a continuance. Well, I'd push for another dismissal based on failure to state a claim. Mr. Uh the the your your your motion to dismiss has been is settled and we will no longer be I will no longer be considering any more motions based on the grounds you previously asserted. Well, and your response to that is just adding claims on the record that haven't been brought up by either parties. And it leaves the appearance that uh you're acting outside of the bounds of your duties as an independent third party. Especially through the attorney that I was provided that offered ineffective assistance of counsel. Well, all I'm asking is do you understand that the criminal I'm not asking you to about the specifics of the case. Generally, do you understand that criminal law is a complicated area and that an attorney trained in this field could be of great help in in preparing and presenting your defense. In theory, yes. Uh do you understand that you will be held to the same rules and laws as an attorney would, even though you do not have the same training and qualifications of an attorney? For example, the district attorney just discussed discovery. An attorney who is trained and qualified knows that they have to make a request to the district attorney to disclose the discovery. The district attorney doesn't just automatically provide it. Once they get that request, they will provide what they're required to provide under rule 16 of the Colorado rules of criminal procedure. The district attorney has said that you have not made that request yet. So that would be an example. So if you came back at trial and told me they never gave you discovery, then I would hold you to the same rules and laws as an attorney would be held to, which is that if you didn't request it, then that's on you, not them. So that's an example you being held to the same rules and laws as an attorney would even though you do not have the same training and qualifications as an attorney. So do you understand that? I don't because my attorney, the ineffective assistance of counsel that is provided by the court, had already requested that discovery. And and I keep filing more the same discovery request because they refuse to release it. Exculpatory evidence. So I'm not again asking you I just used a an example from your case to illustrate the general the general idea. The general idea is do you understand you will be held to the same rules and laws as an attorney would even though you do not have the same training and qualifications as an attorney. True. All right, court will find that decision is knowingly and voluntarily made. So in 25 M 426, what is your plea to obstructing a peace officer, guilty or well, actually, I should probably have the people recite the last offer communicated to Mr. Sullivan on one or both of these cases if it's a global offer. Yes, your honor. In 24 M 439, the last offer was to plead to original count one, no proof of insurance with a $500 fine and four points against the DMV. In 25 M 426, the last offer was to plead guilty to original count one, obstructing, with six months of unsupervised probation and ISAIAH discovering better choices class within five months, 16 hours of UPS within five months and to remain law-abiding. Both of those offers are now revoked. Well, we'll get there in a minute. So in 24 M 439, if the plea of guilty to is to count one, does that am I correct in inferring the offer contemplates dismissal of the remaining counts? Yes, your honor. I apologize. Mr. Sullivan, did you hear what the district attorney just communicated? Yes. If you enter a plea of not guilty, all of the you will be communicating to the district attorney you would not accept that offer. You'd be communicating and the district attorney is free to withdraw it. >> [snorts] >> And if they choose to withdraw it, they may choose not to put any new proposals on the table for resolution of either case, which may leave the trial that I set as a result of your not guilty plea as being the only way to resolve the cases. The new reasonable doubt instruction reads as follows. Proof beyond a reasonable doubt is proof that leaves you firmly convinced of the defendant's guilt. If you are firmly convinced of the defendant's guilt, then the prosecution has proven the crime charged beyond a reasonable doubt. But if you think there's a real possibility that the defendant is not guilty, the prosecution has failed to prove the crime charged beyond a reasonable doubt. And a reasonable doubt can be based on the evidence presented or the lack of evidence presented. New reasonable doubt. Are you going to have an objection to me reading that reasonable doubt instruction to the jury? I beg your pardon? Yes. I'm fine with that. I'm fine enough. People, how long are you asking for voir dire? Just 10 minutes, your honor. Mr. Sullivan, how long are you asking for voir dire? For what? Voir dire. I don't know what that is. What's voir dire? It's the process where you ask the jury questions to find out ahead of the jury being selected whether or not the people who are called to serve as jurors can be fair and impartial. Is that between individuals or in law? Mr. Sullivan, you may recall when I I gave you an advisement that said that if you're choosing to represent yourself, you need to understand that you will be held to the same rules and laws as an attorney would even though you don't have the same training and experience as an attorney. So I'm not planning I'm really not able to coach you through this process. I'm expecting you to come to court already having this knowledge of what it what what will be happening at a jury trial. Well, all I can do is guess at this point. Yeah. Let me put it this way. We will not slow the trial moving forward because you are not knowing or understanding things you should know or understand ahead of time. For example, You know, that's not the only thing you could do. You could get a lawyer and in fact they'll even give you one if you can't pay for it. Yep. Yep. I imagine that'll work. Beg your pardon? I imagine what I clearly you're just going to say 10 minutes, so I'm going to say 20 minutes because I'd rather have extra time whether I need it or not. Well, I will allow you to cut it down to I will allow 15 minutes for closing because there are four counts. Those counts do not all rely on the same evidence. So, there may need to be a little bit more argument regarding how the facts fit or don't fit with those elements. Will any witnesses need special accommodations, people? No. Are you planning on using the courtroom technology? Yes, your honor. Mr. Sullivan, were you planning on using your computer to publish exhibits to the jury? Uh to my knowledge, that's the only way to do it is if I bring my own equipment. I don't understand what you're saying. To my knowledge, that's the only way to do it is if I bring my own equipment, right? Equipment? No, you can have paper copies and share them with the jury um by having them look at paper. The reason why I'm asking if you're planning on publishing with a computer, then you will be using uh the the courtroom technology to accomplish that. And and again, it's a situation where you need to be ready to have that going cuz I'm not going to wait to troubleshoot issues. We won't be troubleshooting issues in front of the jury. Okay. I don't know if I can ask about exhibits conferring on exhibits because I don't have an exhibit list. Is this guy a Mensa member, right? Right here. I'm not asking me whether or not I will allow the exhibits you have to be in front of a jury to to to to see to allow the jury to see and consider the exhibits as evidence. No, I don't. Okay. Again, that's something you are expected to have ready. You are expected to have um you are expected to be ready to do. And so, what I'm not going to do is coach you through the process, and what I'm not going to do is wait for you to figure out how to admit [snorts] it in real time. I'm telling you this now so that you are not surprised when we get to the trial. I don't know if there's anything else I need to take up. This trial is second in priority, so if Mr. Bangs is ready to proceed to trial, this trial will be continued. If the if Mr. Bangs is not ready for trial for any reason then this trial will proceed. With regard to 25M426, I granted the people's request to add count two, speeding 20 to 44 miles over posted speed limit, class A traffic infraction, count three, failure to provide proof of insurance, a class one traffic misdemeanor, and count four, displaying fictitious or altered license plate, a class two traffic misdemeanor. Uh all also alleged to have occurred on April 7th, 2025. Uh are are are your What is your plea to those three new newish counts, guilty or not guilty? I don't consent to enter a plea. I was never served with any of the documentation for that motion. So, the court would first note that it's your responsibility, sir, to make sure that we have current contact information. So, the information that um uh that that when we when we take an action on this case, you're notified about it. Are you insinuating that my contact information has changed? I granted this motion on November 12th. Did you receive a copy of my order? Yeah, I did, and I objected to it and then um the And and did you get a copy of the motion before a head of my um order granting it? No, I just got the the order granting it. I didn't receive anything. So, does the do the people have current contact information for you? It hasn't changed. What? It hasn't My contact information hasn't changed. My my mail continues to go to the same address. That is the only thing that I have noticed. So, people, you have It appears you have the correct email address, and I don't know if you've been emailing copies of what you've been filing, but you are not sending information to the correct mail address. Um I I do believe though that through e-filing, you should be getting automatic mail notifications. Um should he not be getting um mail notifications through e-filing? No, okay. Also, make sure that I um just email him copies of everything that's been filed in the case thus far. And as I stated earlier, I'll get in touch I'll speak with Mr. Sullivan right now to get some updated contact information so we can confer about everything regarding both these cases. Court enters a not guilty plea on Mr. Sullivan's behalf and on counts two through four in 25M426. 25M 426, the request to continue is granted. Anything else we need to take up for Mr. Sullivan? Um just to ensure that we focus on the actual law as it stands and not some of the superfluous materials which have come up throughout the case. I intend to keep a tight lid on um this case may be about and what it may not be about, which Mr. Sullivan, I think the best uh information you should take away from that answer is if I make a decision uh about an argument or piece of evidence that you disagree with, you are free to object. You are not free to argue with me about it. Um if I uh sustain an objection to a piece of evidence or an argument that you make you may not try again to get the same piece of evidence or argument in front of the jury. I shouldn't have to sustain an objection more than once to a particular piece of evidence or a particular argument. Um I'm expecting full cooperation with that, and if you believe I'm mistaken, you are free to object, and if I overrule your objection, your remedy is not either keep arguing with me about it or to keep making the same objection over and over again. It is to wait to see the outcome of the trial, and if the outcome of the trial is a conviction, then you may appeal any error that you think I might have made. Do you have any questions about that? She did file a affidavit in response, which is contemplated under the In this case. This case, but I'm considering it under both cases. So. Well, well, wait a minute. Then it would be untimely in the other case. I'm I'm considering everything timely, everything appropriate. I understand why it might not have been filed in the other one. I'm just doing motions. Okay, then then let me address this, Judge. I've filed I the the motion to dismiss or the notice of dismissal was filed under the statute, and it was without prejudice. >> dismissal? Oh, yeah, okay. The city attorney's motion to >> Yeah, they did that 2 days after I filed the motion to disqualify in the underlying case. So, then I want I don't want to sort of then have this hanging over my head for a year. Who knows what's going to happen, you know, new prosecutor, whatever. So, I want a dismissal with prejudice, and there's nothing in the statute or the rules that would disallow me from filing to reopen that case and get a dismissal. In fact, Judge Giordano was I'm not hearing any of that. Let me repeat. All I'm hearing is a motion to disqualify. I know. This comes This is the foundation for it. She filed four separate orders after the the Supreme Court and the case law and the Nevada Commission on Judicial Discipline said, "Once a motion is disqualified, you have to immediately transfer the case unless you want to challenge it." She did not She was banned from filing any of those orders and signing them. That's undisputed. That's undisputable. That she was banned to do anything, but she jumped in, she got him assigned to another judge, and therefore that shows prejudice carrying over to this case. A deep-seated antagonism, a risk of bias. She lies in her affidavit. >> Stop. Those sort of allegations are totally inappropriate. I've got facts. I know you put I know you put in there's several things in your moving papers that I think are problematic. That's blending it. Bringing up family members, totally inappropriate. Uh you did describe meeting her outside of the courtroom and the like and Anyway, I'm going to go over each of the what I believe your positions were. Your first position was she filed an opposition and argued that your motion to disqualify Commissioner Shannon Norris from could not be had. This was a motion 7 years ago. Uh she replied in her affidavit 7 years ago. I'm sorry. I'm confused. She replied in what? You're talking about the affidavit that was that was recently filed. It's not an interrupt. Okay. This is from the motion 7 years ago where she you're claiming that because she handled a case in traffic court 7 years ago, which I got jail on. Okay. Let me finish. Uh 7 years ago, um because she handled a case you filed uh the basically saying that the court didn't have jurisdiction, and she appeared at that time. So, that's one of your claims for uh bias. The next one you claim is that because Judge Walker sent her the battery case, um and instead of randomly reassigning it, she kept it. You said another matter you claimed it uh was bias. Third one was for conversations outside the courtroom, which you instigated. You approached her on those uh those different instances, claiming she should stay home, take care of her kids, and that uh when she was running you said she would win because she was pretty. So, these are conversations that you uh instigated. The fourth one is uh how she acted at the arraignment uh February 18th, 2026, that she bullied you and facial expressions uh suggested that she was biased. And then um and on your reply uh ordering you not to have discussions with people in the gallery. So, I need this one. Material witness. She'll have to be called as a material witness in this case because um she will have to admit on the stand, I can get her subpoenaed, that she she after after I filed a motion to disqualify, she didn't answer, she issued four separate orders, and me begging her not to have to do that to do that kind of illegality. Erica Ballou got suspended because of doing that by the Commission on Judicial Discipline. So, that material witness, she is going to be vital because they're saying in this case, and it's relevant because the vexatious litigant petition is based largely on that. So, therefore, she is going to be called as a material witness if I can get that done. So, therefore, on that ground alone you've got to disqualify her. I'm going to finish with my my ruling. Um God is opposition hearing 7 years ago was so minimal. Uh I actually believe Well, yeah, and he he does this too, where he he pulls up cases that don't have anything to do with his case. >> 7 years ago. >> Because of this happened. 7 years ago. >> He's talking about a case that happened in front of the Judicial Commission, which didn't have anything to do with this judge, had to do with a different judge. Right. And both of you guys just made the case that was brought up earlier about the fact that he's a narcissist. Plus, he was watching his own hearing in his with uh public that generally disagrees with him. Right. Well, he can't help himself. No. No. Judge Giordano says that she had no recall of it. Um I note that your position is kind of contradictory because uh here you want her recused, but on the same note you have Judge Walker who did recuse himself, and you want him to stay on the case. So, he actually conducted the A trial, traffic trial. And so, if if you were consistent in your positions, you would want them both >> I object. That's not true. I'm making my ruling. Uh the second one, uh Judge Walker's recusal, which you'll need to deal with at the District Court. What did you say, recusal? Uh so, his his uh his self-recusal. Self-disqualification. Self-disqualification. Uh you'll have to deal with that with a writ uh to the District Court. Um You've So, uh Judge Giordano Giordano's keeping of the case was appropriate to me. You've had interaction with almost probably every judge on this bench. Yes. Usually you you wait for us outside, and you have discussions with us. I Whether I say hi or whatever, but uh uh I didn't sense deep-seated antagonism from you. I did from Giordano. Okay. It would be appropriate for her to hear the vexatious petition. Your conversations with her outside of the courtroom were instigated by you. You can't create basis for disqualification. She's entitled to to try to get through the process and and you were you were complaining about the threat of violence because it was the wording of it. I mean your your positions on things were not appropriate, not induce her to All she wanted to do was get through the arraignment, which is just the very beginning of the proceedings. Her her actions were appropriate. I I don't think they showed bias. She's in control control of her courtroom. But it didn't show bias. And I looked at it and I didn't see the facial expressions that you described. She she may have like been stern with you, absolutely, but I Did it show bias? Absolutely not. Um The suggestion that Judge Giordano ordered not to communicate with others while in the gallery, I've seen you in the in my courtroom and you talk to people and sometimes you're too loud. And so her order to not have those discussions absolutely would be appropriate. She She Judge, she she forbid me from talking to people in the hallway. I had a thing I wanted to give a person that said where you can do community service. Where I do community service without court credit just because I want to volunteer. And the the her bailiff Thompson came down and said, "No, you can't talk to anybody you see you come from the courtroom." That's a First Amendment violation. This guy is a Oh my god. You understand you may have a number of defenses which apply to your case which an attorney is trained to know. Do you understand that? I comprehend. Okay. And do you realize that if you'll be if you were convicted of the offense in this case that you're facing a possible penalty um uh two level six felonies. So each one of those would carry between uh 6 months to 2 and 1/2 years in prison. So the total combined penalty could be uh 1 year to 5 years in prison. Do you understand that that's the possible penalty? I comprehend that as well. You realize there are factors the court can consider in increasing your sentence within that range or in decreasing your sentence within that range and that those are called mitigating and aggravating circumstances and that a trained attorney knows how to identify those and present those to the court. I comprehend that. Okay. I comprehend that. Um Attorneys have developed certain skills in investigating your case, interrogating witnesses, and finding favorable witnesses, and obtaining their testimony. They can explain the charges and any lesser known included or lesser included offenses to you. They can gather documents and other kinds of written evidence. They can prepare and file motions before trial such as motions for a speedy trial, motions for discovery, motions to keep unfavorable information from being received as evidence. They know how to examine and cross-examine witnesses at trial. They can recognize objectionable and unfavorable evidence and promptly object to its use. Uh they can present favorable sentencing information and attack unfavorable sentencing information. At a jury trial, they can present favorable opening and closing statements, prepare appropriate written jury instructions, and select a jury. They have the training, knowledge, and skill at properly preserving the record of the case for purposes of an appeal. An attorney can also evaluate the strengths or weaknesses of the case against you and give you expert advice on whether you should attempt to seek a plea agreement with the state, which may result in the dismissal of some of the charges and a recommendation for a favorable sentence in return for your plea of guilty. Uh do you understand all that? I comprehend it. Okay. Uh you must understand if you decide not to have an attorney, you will not receive any special treatment with your defense. You'll have to follow the same rules and procedures in your case as an attorney would have to do. Do you understand that? >> Yes, I comprehend that, sir. Okay. And these documents make statements about an office of executor observations, findings regarding the Porter County Superior Court interaction with Tierra Lenae Butler. And he refused to um present them to me. That's a Brady violation cuz it worked in my favor when I first got it. I think it's appropriate for me at this time now to terminate the for red inquiry deny your request to proceed pro se I'll specifically find that the request is not a genuine attempt to present a legal defense but a calculated strategy to obstruct and subvert the court's proceedings the defendant is utilizing rhetoric of what would typically be called a sovereign citizen movement including raising nonsense challenges and attempting to apply commercial law to criminal prosecution or equitable law. Ma'am, you're saying no but you're talking over me and I don't appreciate it as I'm bound to rule. The right of self-representation is not a license to abuse the dignity of the courtroom or no relevant rules of procedure and substantive law based on the defendant's filings and her statements in open court court finds she's unwilling to comply with rules of procedure and intends to use self-representation solely for deliberate disruption of the proceedings the request to proceed pro se is denied and appointed counsel will remain on the case.
