Further, the court orders plaintiff to pay defendant Peritini additional monetary sanctions of $4,560. Peritini is ordered to submit the proposed judgment of dismissal and for monetary sanctions against plaintiff and in favor of Peritini. Yes. Earlier in the document, so it is additional. I missed that. Yes, it is additional. So, uh, Chile's going to owe Uh, blue bacon about 15 grand when it's all said and done. A I was hoping for $1 million. The next hearing in the case is for the 14th of July, and that is a trial uh trial setting hearing, and it's just Kate and Chile. and Kate has said that she has not been served in this case. Well, we could always just start a pirate crew and call us the call ourselves the Blue Bacon Pirates. Well, we could just play. Not pirates, but similar. I had this dream, and by dream, I mean not. It's not something I actually want to do. It's just something I think would be really funny in a abstract kind of a way. Uh, you know, in Europe, they're like, "Oh, we have this castle. Buy it for a dollar." and oh it's so cheap and then people are like why isn't anyone buying this? It's because it comes with a contract and you have to repair it and so like you're paying an enormous amount of money. The $1 is just the cost to to purchase it but then you have to honor the contract and so it's not $1 at all. It's very very expensive. My thought is why not do that and then not pay and then when they come to collect you're in a castle. What are they going to do? Huh? Yeah. Um, yeah. Well, we we did offer him a deal at the end of this that would have uh reduced the amount he owed. in exchange for him just dismissing with prejudice. And not only would it have reduced the amount of yoke, it probably would have stopped uh the possibility of pursuing legal damages because in California basically the way that you recover legal fees is what I've been doing, what my lawyer's been doing, which is uh sanctions. But at the end of the case, if it's determined that the entire thing was frivolous, mixed with prejudice, there is a chance. It's a very small window and I don't even know if I'm going to be pursuing it or if my lawyer thinks it's worth pursuing, like I genuinely don't know. I'm only bringing this up as sort of an interesting thought experiment. If the case is just prejudice and then you go to the judge and say, "Hey, here is why we believe this case was frivolous from the start, which my lawyer has been filing. he's been putting the filings about gamesmanship uh and all that sort of stuff. Uh at that point, you might be able to ask for more money in damages and sanctions. I don't know what's going to happen with that. I genuinely have no idea. It it might not be anything more than has already been done. However, if he had agreed to dismiss the prejudice, it might not have allowed someone to go back and say, "Okay, well, this is, you know, now we want to uh for him to pay the rest of the legal fees." I don't know if that's accurate. I know someone had said something about that. I was like, "Oh, how very interesting." There's difference between having the judge dismissing the prejudice and then voluntarily dismissing the prejudice. Maybe. Again, I I haven't confirmed that. I haven't really dug into that because it it didn't matter at the time. Now it might matter, but uh apparently didn't take the deal because of the minutes. I don't know what his response was if and when it was offered to him, but I suspect he didn't take the deal, which would have reduced the amount he owed and would have shut the case down earlier, but would have had basically the same end result with his prejudice. So he may have by not taking that deal uh put himself in a worse position. Whether or not I plan on capitalizing on that position is a position that can be capitalized on. I don't know yet. But uh he made choices. Can't your insurance company go after him? So yes, because for those of you who don't know, subregation, can't they subregate? So, well, for part of the case, for a lot of the case, uh we got my insurance, my lawyer and I, we basically went through my homeowners insurance policy. Yeah. And found that it does cover uh this and they agreed that they would cover it. They said that they were going to find their own lawyers because in Washington state you they can do that. And my lawyers argued, "No, this is a California case. California law does not allow that. The lawyers that are on it are going to stay on it." And uh my insurance said, "Nope, not gonna do that." Even though we've admitted that we we do cover it, we're not going to cover it the way you said. I had to hire a second lawyer. Yeah. Basically threat my insurance. Right. Yeah. Yeah. I remember. So once they said, "Yes, we are responsible for it." All distinctions that are uh filed for that money, I believe, goes to them. However, I don't know if they're the ones collecting or if I'm the one collecting it and giving it to them. Yeah. Yeah, right now my thought is I go after all of it. I take my cut first up until they took over and then anything I can get after that I'll I'll slide over to them. If I can't for whatever reason get it, I'll contact my insurance and say, "Hey guys, falls in your court. Have fun." And they're my understanding is insurance companies are pretty aggressive about it. I don't plan on being too aggressive about it because at the end of the day, if it's too much trouble for me, I'll let them do it. They have professionals that will handle. Yes. So, yes, they can go after him. I don't know what the process is going to be until, you know. Yeah. If it's got a chance of segregation, that's where it goes. Yeah. Yep. Uh basically addressing sort of the timeline of what happened. Uh the strategies that were planned and the strategies that were invented and how it played out just in case this happened to somebody else in the future. That way they they sort of have an idea of what they might expect if Yeah, that's a good idea. That's a great idea. Yep. Not to say that he's going to do this again to anybody else. Maybe. Yeah. Pay it forward. Y pay it forward. Yep. If someone, you know, if time repeats itself, it would be nice if people understood what may be beneficial for him or had options. I like to have options and I like to make sure other people have options as well. Yeah. So that's the idea. And yeah, a lot of people a lot of people just panic and Yeah. cave. You know what I mean? They don't Yeah. The Massachusetts case was very helpful. The one that came before mine. Yeah. because it it seemed to indicate that discovery was what was really going to, you know, grind everything to a halt. And in the Massachusetts case, the defendants uh counter claims, they went on the offensive and that it was just time and money and didn't go anywhere. In fact, uh, their claims were dismissed because I think they couldn't establish the necessary $75,000 in damages to federal court, which is $75,000 or more required in federal court. Oh, he's using these circumstances. So, I didn't go on the offensive. I decided to play entirely defense because I fully expected it to fall apart in discovery because his claims against me, I knew, were unprovable because they were false. From where I was sitting, they were false. And that appears to be exactly what happened. So it would be nice, I think, to to be able to give that to somebody and say, "Hey, you know, the world uh very carefully. Here is what happened with me. Take the advice you think is appropriate for you." Yep. Yeah, that's a good idea. You have to play the long game, not the fast game. Yep. Yeah. and he tries Facebook Karen tries to sort of attack the long game by filing all our emotions, right? Or that way anyway. And uh there are problems with that too that going to play in the long game. Yeah, it can be expensive. But in my situation that appears to have uh helped I think established that the case was frivolous because now I can go back and look at all these cases filed and go, "Wow, yeah, that that what was the point of that? What was going on? never interrupt him when he's making a mistake. And that was Yeah, there was a lot of I said somebody in Discord earlier today, I think it was in that I played this defensively. I just was just on defense the entire time. And I essentially let him hurt his own case until it couldn't be pursued anymore. And that's a hard thing to do. I didn't expect it to go for what, two years. I thought two and a half. Two and a half. Yeah. So, like don't think that I enjoyed this, but it it worked. The the strategy worked. Yep. Yep. Remember when I called you when the police stopped me and you sent me the a copy of the insurance card? It was somebody else's name and a different call on the policy as well, right? I hate when that happens. Well, the insurance card looks like it was purchased the day after the stop. Oh, it may have been the wrong one. You tell them that uh the we have a different insurance card. We've got vehicles here. It's crazy. There's no way to get an insurance card that quickly when I'm on when I'm working like that. The only thing I can do is take some proof of insurance that I had in my phone. That's not how it works. Look at the judge's expression though. He's just like, "Yeah." Okay. How could this possibly be purchased the next day? You didn't purchase insurance the next day, did you? No. No. No. What they may have done is what they do is they renew the insurance every six months or so. And what what happens is it automatically prints out ahead of time. And so what may have happened is they give us the cards in advance and then I I get it online and then I put them in my phone. I smell a lot to find. Okay. Okay. I think that explains it. Okay. Dismissed the ticket. Turn that to you. And then you asked me uh about your criminal charges. They were dismissed without prejudice. Now, without prejudice means they can be refiled. So, it's up to the prosecutor to decide whether they're going to refile. I prepared something for the court. Without the prosecutor here, I can't make any decisions. I'll just share some general thoughts with you because I see you got a subsequent driving suspended ticket. you have a court date I believe in August on that. Let me check. So my guess is since you have a new charge right away. Um they may not be willing to dismiss the new charge and they may resurface the old charge because as I said it was dismissed without prejudice which means it can't be filed. So right now you're scheduled for court on the tongue water driving suspended charge on the 5th of August at 1:30 in the afternoon. So, so um without ruling on anything that might be filed on a new case, I'll just share some thoughts with you which are that uh the view that you set forth in your pleadings is we see that occasionally very similar language. Uh I don't know. You know I sometimes the briefs we get in this line are I'll read the exact same. Yours is not the exact same but a lot exact same. Um there is no case in the country that says a state cannot regulate the driving both commercial and private. any public thorough affair. So you know I read your arguments as to why you believe the freedom of travel means you can drive your private vehicle on public roads which are paid for by the registration of the vehicle by the way in part uh that you believe you can drive because you have the constitutional right to travel. Uh that it's never been interpreted that way. So the constitutional right to travel does not apply to overcome the requirements that states have imposed to require you to be to register your vehicle on an annual basis. I like this judge. Yes, the judge did not say if he has the right to travel when the roads are moist. difference if the if the roads are moist are moist clarification especially in Washington because it rains a lot in Washington and the roads do get moist. Yeah. And wet and damp and more moist. And wet and soggy. I pay my registration fees every year because I have to in order if I want to put my car on the road and I know if I put my car on the road with expired tabs, I'm going to get stopped and I'll have to pay the fine and I'll have to go get my car tabbed. I just know that's the way it works and that's how the system is set up. So there's no legal argument there. you know, you made it in a sort of a big way, but I think it's a misinterpretation of what you believe the right to travel is does not give you the right to travel in any state, not adhering to that state's laws. And every state has a registration law like the state of Washington. So, you've asked my for my general Have you noticed that in courts a car is referred to as a motor vehicle? uh friend riding with you in the car is referred to as a passenger. You're engaged in traffic and uh you're when what the problem is when a person registers his private property automobile with the state, he's declaring it a commercial vehicle. No, that see that's that's your interpretation and I'll just tell you that's not the interpretation shared by the courts. We don't see it that way at all. So the law makes very clear that all of us who have vehicles that we put on our roads, they have to be registered. Doesn't matter whether we have passengers, no passengers, if we drive them ourselves or not. Um if it's if we're engaged solely in personal business or moving from point A to point B, none of that exempts us from the requirement to appropriately register our vehicles which is used as a means of supporting the construction of the roads that we drive on. Yeah. You know what you said you've seen a few of these. What compels people to do this is the state abusing its power to license drivers as well as doctors and other professionals. If you don't behave the way the state wants you to in your private life, in your family life, the state through um the family court can have your license suspended. Uhhuh. And that's just strong evidence that Yeah. Great was not set up to make the road safe but to control people and people don't like that. Yeah. No, I I I understand the philosophy behind that. Um we don't do anything here with suspending licenses or not. We just interpret whether the person has a license or doesn't have a license. That's the only rule of the court there. Now, I will say what you're referring to is the ability of the Department of Licensing to suspend licenses for the failure to pay child support as support. What's that? It's not child support. It's government support. Okay. Well, just it's called child support. And that's what it's, you know, if you look on your driving record, you have one of those things there that says it says FA to pay child support. Wow. I understand there's a different way of looking uh but it is not directly related to driving. I get that. But the legislature uh made that they thought how can we leverage people to pay what a court has determined they should pay or the support of uh their children and they decided that one good way to do it was to leverage yep the ability to drive. So that's what the legislature decided to do. They created the law. Nobody has determined that law is unconstitutional. A lot of people have, but they haven't taken it. Right. Um, so in family court, the court rules don't apply. You know that. and do nice if I understand this guy's philosophy correctly. If I determine it's unconstitutional, I don't have to follow it. Yep. Yep. And if I don't pay my if I don't pay my child support because I'm a scumb bucket and they take away my driver's license, right? It's It's unconstitutional, right? And I decided it was unconstitutional and so therefore it doesn't really matter what the court says because I decided it's unconstitutional. Taking away a doctor's license. Yes. Who does who does who does this? I decided it was unconstitutional. Who does that sound like? Well, Lane, I decided what the court ruled for. Yeah. Yeah. Sounds like every fraudster in history, right? Process is streamlined so your driver's license can be suspended through a court procedure where it's a free-for-all. I've seen it. It's called punishment, [ __ ] Yeah. So, I I I like I said, I understand the philosophy you're indicating. I'll just when the case comes to me on a driving suspended charge, I look to see if your license is active or if you don't have the privilege to drive on the state and you view it as a right. The law views it as a privilege and the privilege is um enacted if you are properly registered and insured. Well, it's a privilege to operate a motor vehicle on the highways, but the courts have ruled and it's in my brief. It's a right to travel by your automobile, by your private property auto. No, there's there's no court. Like I said, you can look all you want, but there is never nobody has ever found a case that says a court upheld the ability of somebody to drive in whatever state on public roads. Well, driving is a commercial term, too. Okay. To operate a motor vehicle on any regard. That's even more a commercial term. Look at operate your car. There's no cases that you can operate means using a business machine on a public utility. No, that doesn't operate means I'm operating my computer. I'm operating that's a colloquial my pencil. That's you're you're pushing your example into sort of in black's fifth edition. You'll see that operate means using a business machine for games. A business machine. Okay. I I disagree with that. Under these trustments, public officials act as trustees and are bound by their oath of office to serve the people, the beneficiaries. Their primary duty is to uphold and protect the inherent unalienable rights of the people as mandated by these constitutions. Okay. All right, Mr. Paige. I have more. All right, but we're going to get through this court proceeding and I want you to know you're going to behave at trial. I'm not You are bound by the laws of the state of Michigan and that's how we'll be proceeding. So, sir, as to arraignment, how do you plead? You can plead guilty, you could plead not guilty, or you can stand mute. Yep. Yeah. He couldn't wait to spew it. Could you repeat the last the last part, please? You could stand mute. Your charge will interference with police authority. There is an allegation that on November 4th of 2024 uh while uh traveling southbound telegraph near Breast Street in the city of Taylor that you engaged in behavior that obstructed or interfered with police authority. That is the allegation against you. This is a misdemeanor. It is punishable maximum by up to 90 days in jail and a fine of up to $500. Sir, you have the right under the constitution to um have a trial by a jury and to have the assistance of an attorney. And you have a right to an attorney appointed at public expense if you are indigent, meaning you don't have the money to pay for an attorney. Um, and if the offense requires a minimum jail sentence, there is no minimum jail sentence on this uh case or the court determines it might sentence you to jail. Um, it's my understanding that you have waved your right to a courtappointed attorney. You've already put that on record and you intend on representing yourself. You also have a right to a trial. And at that trial, you have the following rights. to call witnesses to speak for you at trial and you can get an order signed by the court to require witnesses to come to court. You have a right to see here and question all witnesses against you at trial, to be a witness for yourself or to remain silent. And if you chose not to be a witness on your own behalf, the prosecuting official may not comment on your refusal to testify. You also have a right to be presumed innocent unless proven guilty beyond a reasonable doubt. Those are your rights under the United States and Michigan Constitution. Do you understand what I just read to you, sir? Yes. I'm not asking if you agree. I'm asking if you understand. And is that a yes? Yes. I I understand. It's clear this guy spent last night googling how to get out of jail free and is now repeating. And that's what we're hear about is we're still pending trial. Um, and weren't Oh, the pre-trial services violation. That's right. You've got a positive UA from November 1st for THC and cocaine. November 20th, a dude. He's going big time. One, but concern about THC and cocaine. November 22nd, UA positive for cocaine. So, that's why we're here today. Um, and I remember in the past that you were representing yourself. Um, is that still your intention? Yes. Okay. So, um, let me turn to the state as to this warrant issue and then I'll turn back to you. And Mr. Weston, uh, your honor, this time the state would be asking that the, uh, current bail be increased uh, $10,000. Uh, it was previously, you know, court, the state previously asked that amount at arraignment. Court previously imposed 15,000. um that sometime somewhere throughout the process the court decreased the bail to 5,000 he imposed he posted that the bond for that amount and which I believe he was released on October 29th and within a month we have all these pre-trial violations and so the state has substantial concerns about him not following the release conditions that he's required to follow especially being uh uh especially being on uh pre-trial release for DUI. And so the state's asking that the court impose $10,000 bail at this time and that he either posted or turn himself in. So, Mr. Valentine, so I uh object to state motion. Uh the release conditions that were set were not returned. I can hear you. I can Okay. Yeah. the release conditions that were set were not returned uh to its original state. Uh I only the release condition only changed because the three charges were added and once the three charges were dismissed or at least conditions were supposed to be returned to personal recgnissance. There was other individuals when I was in custody that were in the same situation. The state brought charges against them, but the state didn't have the physical evidence yet, and they released those individuals on their personal recognizance and waited for the results for the Now, now here here's a here's a good thing. This guy actually might have a case if he knew how to present it. Yep. Yep. I was thinking the same thing, but of course, he has no idea how to present it. get a lawyer the evidence to pursue those charges. But with me, the state is being prejudiced and tried to keep me um with strict release conditions even though the charges were dismissed. Are you sure you understand her? Because Judge Shackleford doesn't exactly look like a bridge. So, I'm not sure how you're standing under anything. It was at that moment I realized all the evidence all the discovery on this matter or is there is there toxicology reports that are pending or uh based on my knowledge your honor this is there's no blood draw on this case the state is ready to proceed it was uh American national Valentine that did request the continuence of trial confirmation on 11 so you've got everything you're doing tax reports okay all right so all right so back to you Mr. Valentine. Um, anything else? I'm sorry. American National Valentine. The state was awaiting the toxicology report uh for case number 480027328. Those three charges that were added on to the case was the reason why I was in um on the ankle monitor and working with Friendship Services. And so since those charges were dropped, I I'm only on the case for my DUI, my first DUI. I never had any previous DUIs. It's my first DUI. I was only brought into custody for the extra charges that were added on. And those charges were dismissed. But the release conditions were never changed. So even my bail, they didn't even lower the bail. I had to argue with the court just to get the bail lowered even though the charges were dismissed. So, this one is alleged from November 13 of 2021. And then I see that there was um a January 1st of 2024 that was dismissed. And now it looks like that has been refiled with an arraignment date scheduled for January 14th. I know don't know if you've gotten that in the mail. Yeah. Okay. So, all right. So, you're right. These conditions are only about the case alleged from November 13th of 2021. Gotcha. All right. And that's the court order on that matter. Um 18730693 was the pre-trial services requirement and the requirement of sobriety. All right. So any So you're saying that, and tell me if I'm wrong, you're saying that I should release you. Uh set this on for trial and uh what about conditions of release? So the conditions could to release, I should be back PR as I originally was with this charge. If on the other case, like how you said the the the case was refiled, it's going to be in January. If the state wants to set, you know, release conditions for that charge, that should be done on that case. But they're two separate cases now, right? Does that make sense? Have you ever considered that your bail situation might have more to do with your refusal to recognize why? Why? Yep, it does. And there was um All right. I I guess I don't agree with you. There was a a request to uh October 28th to change release conditions and that was denied. Guess I was me um from the court's docket. That's what I'm reading. And so that was considered already and that was denied. So and now I have these allegations from pre-trial services. So all right, Mr. Valentine. Um We have uh we've had difficulty with getting compliance while you're on release. We've had difficulty with getting you into court. And so I am going to increase that bail amount to because 5,000 apparently isn't working. The guy keeps doing the same dumb things. Why don't the court trust him to just go out and do it again? Right. And that's what they're includes. So he can push somebody, you know, right? So So now they're gonna increase the bail because of the of the violations. Like it's great that he's he's arguing that that part of his charges, original charges were dropped. Yeah. It doesn't change the fact you're doing cocaine. You're on bail. Yeah. Like Andy, we filed part of it, right? No. let me go. I don't need to pay you money. Right. But but okay, so that's actually if they if that's like Okay, so you have several charges, right? They drop some of them. So part of your bales is is figured out on the number of counts you have. So if you reduce the number of counts and it should reduce the amount of bail. Uh okay, all of that's a fine argument. The fact that there are two cases is a fine argument. What he's skipping over completely is They're there now because he's on a bond violation for doing for doing THC and cocaine several times. He wants to be released on the I swear I'll come back. Right. Right. Right. On PR bond. I'm going to go a PR bond, you know, because you know, while I had a cash bond, I couldn't maintain the bail conditions, but release me with a PR bond and I swear I'll do fine. Now, see, I don't think he can write his own briefs because he ate all the quayons they gave him. And I don't know what else to do. Pre-trial services supervision isn't working. Um, and so at this stage, a 10,000 cash or bond bail needs to be posted. You're appearing on Zoom. So, you either post that 10,000 cash or bond bail um by Friday at 3 or you're in custody by Friday at 3. So, you make that decision. Um and then we'll have a hearing um on set this uh where are we? I'm just going to set everything for that January 14 day and so that we've got everything together what time that is. But you either, as I said, 10,000 cash or bond bail to be posted no later than 3:00 on Friday the 20th or you're in custody by Friday the 20th at 3 no later than 3. But we'll set this hearing. The next hearing will be January 14th at 2:30. So any questions about your obligation there? Uh yes. What are the nature and cause of these charges? Oh my god. Your charges criminal spend in the third degree. The complaints are in the the court file. And uh what is the criminal jurisdiction like? What's the nature of the causes? Uhhuh. Is it under admiral jurisdiction or common law jurisdiction? Washington state RCW 4661 violation of the state law. You're in Thirsting County District Court, which has jurisdiction over you as it alleged to have occurred in Thirsting County. But I'm asking what's the nature and cause of the charge? Is it under a common law? Is it under common law? It's under Washington state law. Don't you have the duty to make the nature and cause clear to me, ma'am? Do I have a right to know the nature of the cause? I have the only reason I even know what you're being charged with is because the judge clearly stated it on the record. a DUI from 2021 and a second. Do you think there's something more? A bill of particulars might be something that would be useful to you to send to the prosecuting attorney's office. But I requested I've requested a bill of particulars and I've requested the trace the case transcript and I've gotten either. Yeah, it's not going to be transferred. There's nowhere to transfer it. You're in the correct jurisdiction. You're in there. I said a case I said I asked for a case transcript. and a bill of Yeah, it's transcript and a bill of particulars and I still haven't gotten it. All right, we'll follow that up with the prosecuting attorney for the bill of particulars and then the transcript um that would be uh from the court if you wanted an audio recording of the proceedings. All right. So, still haven't made clear the nature and cause of charges, ma'am. All right. Well, I think I have. So, you're to turn yourself into Thirstston County Corrections no later than tomorrow by 3 PM or post 10,000 cash or bond. We'll have our next hearing January 14th, 2:30 and you stay clean and sober and law-abiding and you're still on pre-trial services supervision if you're out of custody and you comply with them.
