Summary

A First Amendment auditor, alleging an officer misapplied Florida's 25-foot statute during a traffic stop, filed a formal complaint at Temple Terrace PD. The auditor also claims he discovered an unlocked patrol car with a visible firearm in the passenger seat, which he says is a state law violation and has caused past firings. The video documents the auditor's interactions with on‑scene officers and a supervisor, along with his subsequent public-records request and complaint about delayed payment. This incident may matter for examining police compliance with civilian-recordings statutes, internal accountability for unsecured weapons, and transparency regarding related body‑camera footage.

Why it may matter: This incident may matter because it documents an auditor’s claim of a statute misapplication, a visible unsecured weapon in a patrol car, and subsequent administrative friction—illustrating common friction points between auditors and law enforcement over recording rights, vehicle security, and public-records access.

Welcome to the Chuck Bronson channel. The other day I'm recording this stop and this backup cop shows up misusing Florida statute 843.31 trying to push us back unlawfully. >> It's fine. You want to film, but you guys got to back up. You guys got to back up. >> Where at? >> Uh right to the post. >> For what? >> You guys can film. >> For what? >> There's a law 25 ft rule. >> No, there isn't. Where's the intent? >> Back up. >> Back up to the >> So, you're going to move us back. I want your makeup. >> What is it? >> What? >> I couldn't hear you. >> I already said it once. >> Okay. >> Where's the intent? 8131. Man, have you not not read it? You don't get to just push people back 25 ft. >> Okay. >> You not know the actual statute? >> What's that number now? >> I've already said it. >> Thank you. Yeah, >> you need to go read the statute. You're misusing it. >> I'm going to file a complaint on you tomorrow. >> You got to get a job. I do. You got to get a job. >> You can't just push people back. That's only if if we harass, impede, or threaten you. 137 What a piece of crap. They're giving us hearts out the car and hearts. >> That's why you got to know the statue, you know, verbatim, >> right? Cuz that just shut him down. He was like He was like [ __ ] a brick, right? They're still here. And he's gone. He's He left. He said, "Screw this. I'm out of here." The cop beat it. That's funny. >> What's his number? 146. He'll be the next one. Complaint. >> Now, this whole story turns out to be a lot more than just this. Thanks everybody for hitting that thumbs up. Don't forget to leave 10 comments below. Let's go. >> I don't swear. Swearing. Okay. >> Try to keep it down, but yeah, whatever. >> What'd you get pulled over for? >> I was going 53 and 40. >> Damn. >> So, >> did you get a ticket? >> No, just >> Oh, cool. Usually the cameras will run them off so they freak out. Yeah, I I just uh I don't get pulled over really ever. I don't ever got pulled over because uh my license plate was expired and that was it. >> Cool. My first >> Well, we're glad you're good. You're still alive and all that. So, >> be careful, man. >> You're welcome. Have a good one. Be safe. >> So, the next day, we go over here to Temple Terrace PD to file a complaint for last night, the misuse of 843.31. And this is what I find. You won't believe it. I'm looking inside. I notice >> the doors unlocked >> and I notice something sitting in the passenger seat. >> Battery. I think this is that unlocked cuz Fords drop all the way in. You know what? Sitting there. Hey, come here. Need to find a similar model. Is that car unlocked? >> I don't know. >> Yeah. See how this one's dropped all the way in? Can you guys see that? See how the lock is dropped? I think that Pull the handle. See if it's unlocked. >> And look what's in the passenger. Yeah. Come look at another one. They go Fords go all the way down in when they're locked. >> I'm telling you. Come look at this one. See how it's all the way down in? It's not sticking up a half inch. I'm telling you, that thing's unlocked over there. >> Yeah. >> Go look what's in the passenger seat. >> There is a difference. >> Yeah. Go look in the passenger seat. >> Yeah, it's loaded. >> No, look in the passenger seat. You did? >> I don't know how you can tell if it's loaded, but >> Yeah. What is it? 115. I almost want to just wait here until they come out just to call them out on it so we can watch it happen when it goes open. >> Well, we'll go and look and see if it changes. It's the easiest way to do it. >> That's what I do. I go back and look afterwards. Thanks everybody for hitting that thumbs up. Huh? Are they cops? >> Maybe. I don't know. >> They didn't look like it. >> Hey, do you guys know who car that is right there? >> This one. >> This white patrol car 151. I don't know. >> It looks like it's unlocked with a with weapons in it. >> Unsecured. >> The Fords and all the other ones, they drop down in all the way. They're not sticking up a/ inch like that. >> You can notify the supervisor. >> Pull the door handle. See if it's unlocked. Easiest thing to do. They won't do it. Damn it. I would you might want to check the door handle real quick. Not just call >> just for liability reasons, you know. >> I can like I said >> just open it and lock it. >> Call the supervisor. And I mean I can do that too, but >> just, you know, smart thing to do. >> Yep. Unlocked unsecured weapon. Can't be having that, man. There's kids in this town. >> Whoa. There's a school right across the street from this department in city hall, too. >> Wow. >> That's why I pushed for him to open the door. That way we That way we had 100%. >> Yes. Yeah. >> He's texting whoever it is now. He's in that car. >> Not my first rodeo. >> Yeah. You called that one, man. Good call. >> I' I've gotten a captain fired over it. >> Yep. Well, he resigned a week later, but same difference. They got an assistant and they all >> the the mayor somebody came down and talked to us too last time. >> City attorney over there. Oh, >> they're having a meeting here tonight, aren't they? >> Yep. 6 o'clock. >> 6:00 p.m. be a meeting in there tonight. >> I don't think they wanted us to go up in the elevator last time. >> Right here to the left is the clerk >> for public records. >> We're going to need the public record or who's who's got car? >> It's upstairs. Upstairs is where >> But it says upper. Where's the police department then? >> The police department's on the third floor. How can I help you? >> We need to speak to somebody in the police department. So, >> how can I help you? >> Uh, there's a car outside, a patrol car that's unlocked with weapons in it laying out loose. >> Yep. >> Yeah. >> Car. >> Yep. >> It's a danger to to the entire community. We just uh there were three officers that just came out of the side fire entrance over on the side >> over it's over here though. >> Yep. Yep. And they opened the door of the car in front of us and locked the door and closed it. But we >> Well, they wanted just to walk away, but I demanded no. >> You need to open the door and lock it real quick. That's just ridiculous. >> So, we need a supervisor to file complaints and do some other stuff. >> Hang on one second. >> And we were here for other issues in the first place. So, that was just >> um for a minute. I'll have something. >> That works. Perfect. Thank you. >> Same as the rules as last time. >> You want to get public records? >> It's probably from the PD. I think you don't have who's got uh what officers assigned to what car. >> We get public records. >> That's what I figured. It's going to be upstairs. Where do we get public records for the PD then? >> Um, there's a black phone on the other side of the hallway. It'll give it says PD records on it. You'll click it and it'll ring to the third floor. Okay. >> And then they can come down. >> Okay. Okay. >> Yeah, we've probably got somebody already coming down from the third floor already. >> Okay, so that's good. >> All right, that works perfect. Thank you very much. Have a good day. That was such a good find. I mean, after last night with with the way they behaved last night and now that today. >> Wow. >> Caught mouth off. >> Got lippy. And uh >> How you doing? >> Good. How are you doing today? >> Good. I understand you want to talk to a supervisor. >> Yes, sir. >> What's going on? who is assigned to car 151 over on the side of the building right now. >> Uh I'm not 100% sure. I will go find out though. What's going on? >> He left his vehicle unlocked with the service weapon right >> in his passenger seat. >> Okay. How do you know? >> We've got it on film. >> You got it on film. Can I look at it? Do you mind if I see it? And a couple detectives witnessed it, too. >> Yeah, >> we did. They wanted us just to walk away and said, "We'll call somebody." I said, "No, you need to like lock the door real quick." Not that's just like too much liability. You know, you're going to get in trouble, too. >> Yeah. >> Go that way. >> Yeah. Okay. So, >> and he's asking him right now about the car. And we'll go right over to here. Pull the door handle. >> Cuz I know the for >> How do you know that? How do you know that's unlocked? >> Because the nub's sticking out a half inch. >> Yeah, you can see the door lock >> and then the cop walks up and opens it in front of us on camera. >> Clearly. Oh, you see the the the little knob that >> the fords go all the way down in. >> Yeah. >> We didn't touch it. >> He just did. That's how >> Yeah. Yeah. Yeah. >> I tried getting him to open it, but he was too afraid. >> I wasn't touch only if he paid something. >> So, I didn't touch it. >> Do that. >> Okay. >> But we made one of your officers do that. So, >> yeah. Yeah. Yeah. >> But he just locked it. >> Okay. How would you How would you like us to handle this? What do you want? Um, well, I mean, I'm sure that if I pull your policies, it's definitely probably a policy violation. >> It's a gun violation, unsecured weapon. >> Some other stuff probably there cuz that's naughty. Like, that's naughty. >> It's a state violation, too. State law violation. >> What's a state law? >> You can't leave guns unattended and unsecured. >> You sure about that? >> Yeah. >> In a car? >> I've seen cops fired over in the state of Florida. >> Okay. Well, I mean, over policy, but is it state law? Is there state law that violate? Pretty sure your gun has to be secured at all times. You're not allowed just to lay a gun on the sidewalk and walk away from it. >> Remember though, we got open open carry laws now in Florida. >> I know, but still that's not open carry. >> Yeah, >> you still got to secure your weapons. >> I'll look at that and see see what it says all that. But um so what so what would you like me to do? Would you like me to just handle it internally or you guys wanting to file a formal complaint? How do you want to >> formal? >> You want to file a formal complaint? Okay. So, what I'll do is I'll go ahead and get the paperwork for that for you guys to do. >> Okay. and let you do that and uh we'll take it from there. >> Okay. Grab another set of paperwork too. >> We also came in for a different reason why we was and this happened as we were coming in. >> Okay. >> So this So what's the other >> Okay. So last night at 11:40 p.m. we were down at CVS at 56 and Fowler. >> Okay. right for a traffic stop. You guys had pulled somebody over and we were standing, >> if you are looking at the doors to CVS where the curb comes and the abupment ends for the curb. >> We were standing on that little abupment right there and the officer's car was all the way over across the parking lot. Clear across the parking lot. His window was up. We never spoke to him one time. We never said anything to him. We never got close to his car. We never interfered at all. We didn't do anything wrong. We just kind of stayed at the end of that abutment where the curb is and just filmed from that edge right there. >> Okay. >> I could see on his radio that he was talking on his radio. So, I don't know if he called for backup or somebody drove by and saw. >> It was our assumption that's >> that he called. The next officer that pulled up came over to us and it's Guerrero is who it was. Car 137. He said his name and badge number so quickly it sounded like 4390. All we heard is 43 for sure. >> I'm not sure what it was, but it was >> Guerrero. >> Guerrero, maybe. Probably. >> It's probably It was so hard to hear him. And I asked him a couple times just like we're speaking right now. I said, "I can't hear you. I can't understand you." >> And he pushed us back via the Halo law. >> Said, "I already told you. >> I'm not going to tell you again." 20 something >> 25 ft. But that's But we have to have intent to harass and pee. It's 843.31. I was saying where we were standing what was occurring. There was no reason for him to act the way he did. >> We didn't bother nobody. >> We said that to him like when where we were standing and you looked at the car as he walked up to us. >> We were already 25 ft away. >> You need to be 25 ft away. And I said, "We're clearly 25 ft away and we haven't said a word to anybody. We're not doing anything wrong." And he pushed us back and he identified very very quickly. Like I couldn't even tell you his name. That's how quick it was. and I couldn't understand his badge number. And then he went right to the point to where it seemed like he was going to arrest us if we didn't move right then and there. So, we complied and moved back a little bit from where we were. And then as he was walking away, he smuggly told us to get a job because we were kind of giving it to him a little bit at that point cuz he had already given it to us. >> Not really. I was just saying that 843.31 and I was trying to explain to him. That's all I was saying. No, I mean like we were more heated in our in our vocal of him, but we weren't swearing at him at that point as he was leaving like >> Yeah, we didn't threaten or anything. >> Yeah. Nothing for him to behave like that. >> I told him that I was going to come in today and that's what he said. He said, "Get a job." >> Okay. >> And I kind of very unbecoming of an officer. >> Did you get all that on video also? >> Yep. >> Yeah. All right. So, not trying to pass a buck. >> Um I'm with it. So, I'm not trying to pass the buck, but um so neither of these individuals are >> in my sphere of responsibility. >> It's not my squad. >> Yep. >> Um so I' I'd rather have either their supervisor >> or someone higher up go ahead and deal with the situation. >> Not that I don't want to. It's just >> we assume that would be normal cuz this one's Yeah. >> So take care of it. So let me do this. Let me go grab you. Um let me grab you two forms. >> Okay. >> Um or one for each of us cuz we're each filing complaints. >> Okay. So, you're going to do this individually? >> Yeah. Yeah. We're both or do you want to do >> We can just do one for however you guys want to do it. I'll grab I'll grab two forms for you then. >> Okay. >> Um you can photocopy if you you know if you want to if you decide that you want to do >> your own that's fine. One's going to get the point across. I think >> you guys go ahead and fill those out. I'm saying you got to get them notorized and all that good stuff. Um, but uh >> the pro the problem is too is from 25 ft it makes it especially at night it's very difficult to see clearly and hear clearly at all and then you're going to push us another 25 ft back where we really can't hear or anything what's going on. That's that's violating our rights at that point at that point. >> So like I'm not going to dispute it. I wasn't there. >> Sure. Yeah. That's why we have video that you can't dispute. I would say I I would say that maybe in the future like um if you have something that's happening like that right then get with the supervisor immediately that's that's on duty at that time. >> Yeah. >> He just took off and he he bolted from >> at 7fold 7777 donated 5 Canadian dollars through super chat. In other news, cops continue to investigate themselves and find no wrongdoing. Shocked face emoji, lying face emoji, tangu emoji. We're 24/7 >> now. Yeah, you'd have to go to the phone, that little phone booth that's there in front of the uh the door, >> but we're 24/7. You can >> typically it's better to come in and see command staff though. When this is when it's something like this, >> you know, it's kind of hit or miss >> and it's better for us to cool down too after getting your rights violated. It's kind of traumatizing. disagree with that. >> It's like, >> yeah, >> sometimes we have to step back, go back, watch and look, think about it, talk to a lawyer. >> I get your point. >> You know, sometimes if you're really upset about something, you go, >> it doesn't feel good to have your rights violated. I know it's common for some people, but it's not a good feeling. I mean, >> so try it next time. If you feel that something's going on, you know, call and and I'll tell you because this is why because you can always like if you're not getting If you're not getting the answer that you're needing at that point with the supervisor, you can always go up from there. >> Mhm. >> You know, >> yeah, >> it but but that's kind of the starting point. >> And to be honest with you, >> that's probably at least for the situation yesterday, that's probably what they're going to do. They're going to they're going to say, "Hey, we're going to start at this point. >> Here's his supervisor." And in that case, it's going to be um Sergeant Mason. Here's Sergeant Mason. Talk to Sergeant Mason first >> and kind of go from there and let Sergeant Mason handle it or whatever. I don't know. >> I'm just saying that's probably >> whatever you want to do. I mean, >> yeah. >> Yeah, I get you. Let me uh let me grab those uh forms for you and we'll take care. I like that. >> Yeah, I really do. >> You got a tricycle you're riding around the halls in here? >> Hey, listen. my height. I probably >> I like I like him better though when they're doing the rush stuff. >> Yes. >> When he does the rush parody way. >> Yeah. >> All right. >> Hey, >> I went ahead and did four. >> Okay, that works. >> Just in case. >> Okay. >> Um they're kind of divided up here. Uh the instructions are on here. Just follow the instructions. Fill it out. Okay. And then uh >> you got to uh you got to get it um notorized. >> Okay. Would um the description would just a link to a video work for the description for you? That way you can just watch it in real time instead of >> seeing >> a clickable link like a safe clickable YouTube link or whatever. >> Yeah. just write in the hyperlink in there and you can just >> because it's hard to send video files without losing resolution and >> but I mean the camera the camera doesn't forget. It doesn't miss memory. I mean it doesn't do anything like it tells the perfect story. That's why we all wear them, right? >> So >> that's a good question. I don't have an answer for you. >> Okay. >> Um >> I mean cuz that would tell >> as you're filling this out >> Uhhuh. You could probably call and talk to um ask to speak to Sergeant Smith. >> Okay. >> I don't know if he's still here or not. >> Tomorrow is another day. >> Yep. Tomorrow >> has to speak to Sergeant Smith. >> Mhm. >> And ask him about it. >> Uh I'm sure there is a way that we can do that and get that uploaded into our video system. >> Okay. >> To view. So >> that's fine. >> I think that's definitely a possible. >> Yeah. That way you guys can see it and there's no questions. And then it's not just words written on a paper cuz I don't know if he had a body cam on last night. I like we didn't see anything and he would body. >> How do we uh request um you know um public information? >> So you go through our records department. >> Okay. >> And and do do the request. >> Is that on there or something or >> you were pointing at it so I didn't know that was >> it's not on here. But if you call um if you call our records, if you call this number right here, >> can I speak to records? >> And >> because we tried to go in there to do it in the city, but they said that police department, it would be through records. Yeah. And you can do a public records. >> Is she Is she or he still here now in the records department? Can you send them down and can we just give it to him right now? >> Uh let me find out. You want to go find out? >> Yeah, perfect. Find out. Yeah, cuz we're all done otherwise. So >> Okay. Yeah. >> Okay, cool. Thank you. Yeah, I appreciate uh I'll I'll find out the the the link for you if there's a way if there's a way for y'all to do that >> and uh >> that way she'll have and stuff too. >> There's going to be two different people on that. So, let me find out for you. >> Okay. All right. Perfect. Thank you. >> Something like that then. >> Yeah. So, this what you guys got going on here beyond you know like >> my you know. >> Yeah. >> Um >> so just um just send the video to that. >> Okay, perfect. >> Public records request >> I will take that request from you right now. >> Okay. >> Um >> however you want if you want me to have them contact both of y'all or if you want to have you want to be a primary contact person then I'll get your information however you want to be contacted. Yep. And then what they will do, I will email that off to >> records. Yep. And then they'll answer >> and then they will start they will start the process. They'll get with you, let you know how much it's going to cost, what all they need to do, and >> Yep. >> whatever information needs to be exchanged at that point. >> I'm fully with >> Well, the problem is now is if you file the complaint before you get the public records, it's going to be under investigation for the next year or two. And so, you're not going to get any public records. That's the only issue when you go to file complaints and try to get public records at the same time. It it becomes a problem. >> I don't know how I mean, however you guys want to handle that. >> That's all right. I'm going to request them anyway. So, it's no big deal. It's no worry. >> Yeah. >> Um, >> so do I just indicate for 151 for the car number and then you guys can figure out who's assigned to that cuz I need his name or or her name, whoever's >> name, badge number. If you um >> So, do I just put that in hand? >> Yeah. If you put if you put Temple Terrace Police Department vehicle, you said it was 151. >> I got the plate, too. >> Yeah. All the cars are assigned to officers. >> So, they will know who's assigned that car and they will they will handle. >> Okay. So, we don't need his. So, let's go from last night then at 11:40. I don't know the incident number or anything. I just know what time it was. >> 11:40 at CBS. >> CBS on Fowler and 56 down here. And it was car 147 and car 137. >> 147 and 137. >> Yep. I'm going to want both of their body cams for that incident. >> And it should be probably like 10 minutes long. Like it shouldn't be very long at all. >> But yeah, I I'm going to want both of their body cams cuz the 137 is the one that showed up. The next day, we get a call with an estimate for the uh public records that were requested. We go in to pay. You know, we I think we ended up showing up 5 minutes before they closed and then they refused to uh allow us to pay for the public records and said, "Try again later." Then, Eyes on the State put in a call to the attorney general's office and um we're just waiting to hear back. We're going to get the public records. Stay tuned. It'll be an update video. But what do you think? Should this cop be fired? Should both cops be fired? Let me know in the comments below what you think. Thanks everybody for watching. I'll be back.
