GRANTS PASS POLICE OFFICER VIOLATES OREGON LAW ON CAMERA!!!! GRANTS PASS FIRST AMENDMENT
Summary
Bay Area Transparency uploaded a YouTube video titled "GRANTS PASS POLICE OFFICER VIOLATES OREGON LAW ON CAMERA!!!! GRANTS PASS FIRST AMENDMENT." The video's title suggests it documents an alleged violation of Oregon law by a Grants Pass police officer, captured on camera, and frames it within the context of First Amendment rights.
Why it may matter: This video is relevant to the research theme as it directly addresses potential misconduct by law enforcement during an interaction that may involve First Amendment activities, such as filming in public. It could provide evidence for discussions on police accountability and the rights of citizens to record law enforcement.

Ma'am, I'm just going to start a new story on this. >> telling you I don't appreciate being filmed. Take your camera off of me. >> give me your the card, I can walk away from you. I'm not >> your camera off of me. >> Well, I don't need it. I don't need I don't need it. You No, no, I don't. You're completely wrong. No, I don't. >> What are the laws? >> I know I know them like the back of my hand. Ma'am, don't get rid of that. I'm going to request it before I leave here, okay? >> You have to submit a public records request to get anything >> Excuse me. I trust me, I know how to do it. >> If I'm just trying to get your picture. >> What's going on, Bay Fam? It's your boy, Bay Area Transparency. We're back at it once again. For this video, we are in the state of Oregon in Grants Pass, Oregon. We went ahead and went to the WorkSource building and got some crazy attitudes from people. I was actually on my way out of town at this point, so I was trying to hurry up. I only had 30 minutes left, and I went kind of soft on them, as you're going to see. And at the end of this video, we're also going to see the police officer in this video who I thought was going to do a good job violate the Oregon Revised Statute. There's an ORS in Oregon that says police officers, any law enforcement, cannot gather information on any group or individual about anything they're doing, any of their activities, their views, their political affiliations, anything like that, unless it is directly related to criminal activity. This gentleman tells me right in this video, "I'm not doing anything related to that criminal activity." Then proceeds to follow me around for almost an hour. It's about maybe 45 minutes after this stop is over. He should have been gone. He didn't. We are going to be requesting the body cam footage and all of his reports so we can show what he did because I got it on camera anyways. Remember, these videos are always unscripted and posted in chronological order. Don't let the employee say it didn't happen like that, that video is heavily edited because that's not true. And we always keep the full unedited version in case we have to prove they're lying. Follow us on Facebook Bay Area Transparency official. Follow us on Instagram at Bay Area Transparency. Subscribe, like, and share, baby. BAT and I'm out. >> Open till 5. I'm more interested in a lot of the other rooms. Is there a water? >> You guys have a water fountain? >> We have the exit. >> Ooh. All right. Okay, perfect. What is this? Phones room, video room, dressing room. Close the door behind you. It's like some computer classrooms, I guess. This is like a conference room right here. This is This is the WorkSource Rogue Valley office, a big big lobby office in here. Um shit's big. It's really big. All kind of cubicles cracking. Excuse me? >> You can't film in here. >> Oh, shoot. Why is that? >> Well, it's a state office he's filming. Oh. >> W- Why why is that? >> The supervisor's coming. >> Oh. Yes, sir. You're not allowed to film in a state office. >> What? Why is that? >> That's just the rule. >> It's just the rule? Oh, where are you getting it from? Or >> This is a state office. This >> Is it like in your policy? Is it a law? Cuz I think it's kind of contrary to the law. >> This is the WorkSource Oregon building. >> Mhm. Yeah, I know. I know where I'm at. Yeah, I'm I'm I'm doing a story. What you're saying is contrary to the law. That's why I'm asking. >> I'll get my area manager. She's in the building. So, if you You something. >> I mean, I don't need to talk anybody. I'm just going to do my recording and and my story. Um maybe you should get some more clarification on it cuz I'm pretty sure you're wrong. >> Is there something you want me to get someone? >> I'll get them. I'll get them. >> It's important for them sometimes to get clarification on what they're talking about. >> I'll get >> No, I'm good. >> Okay. Well, we can't have recordings going on in our office because of confidential information. So >> What confidential information? >> Um people that are applying for our services, it's confidential. >> For sure. Well, yeah, I'm not looking for any of that. I'm not recording any of that. I'm just recording in the public areas. So I'm doing a story um and I don't know where you guys are getting the information from. You guys might not want me to record, but it is a right that we have to record. >> Okay. >> In public areas of a public building. So >> But not when you're have access to confidential >> time. Yeah, if there's access if there's confidential information, you guys are supposed to like protect that stuff. >> Well, if somebody's on a computer though, they would have confidential information on that computer screen. >> Well, then it shouldn't be facing the people. But if somebody if a worker's on a computer, I'm going to record it. If it's some random person in here that's on a computer doing something, I'm going to keep them off. But the the thing is is what you guys are saying don't does not trump my constitutional rights, right? And so you're you you should call somebody or figure it out, but you guys are completely 100% wrong. >> Okay. >> Yeah, we can record in any public areas. Yeah, do your thing. Thank you. >> Thank you. >> You know, it's always important for them to look into it a bit more before they start pushing that issue out because you miss something and you miss the information that's actually real and then, you know, there's problems, right? So >> Do you notice that says staff only? >> What does that mean? >> Staff only. Staff only. >> Do you work here? >> Yes, I do. >> Oh, okay. Well, I'm not in there, so. >> Well, you can't be recording places that say staff only. >> Why do you think that? I don't understand why you guys think that. >> Because it's confidential information area. >> Well, I can be right here, right? >> Yeah, but it's staff only in this area. Signs right there. >> Right, and I'm not in that area. >> This is all part of that area. >> No, there's restrooms right here and I was sent down here to go to the restrooms and the water fountain, meaning I can be in this area. >> Yeah. >> So, you guys are just wrong. Anything that's open in the view of the public in a public area, the public can record. This is a constitutional right. I'm surprised you guys don't understand that. >> It's policy to do that and he's refusing to stop, so. >> All right, we'll get something out. >> Have have fun with it, man. Maybe you guys will catch a little education. It'll be good for you. >> He's illegally recording me and he's uh >> Um >> About 15, 16, 19. Something like that. About 30. Yeah, he's he's recording me. >> You don't have to, but he is. Yes. Uh gray shorts. Uh probably in his late late 30s. Or early 40s. Uh medium build. Probably about 5 8, 5 9, maybe. >> 6. >> Oh, he's 5 6. >> No, I'm 6 ft tall. >> Oh, he's 6 ft tall. >> Hey, you took a few inches off. I'm just trying to help you out. >> Um Yes, so Uh red hat, about red shoes. And then gray purple shorts with green and purple socks. Oh, you said >> I don't have to hold it. >> They're pointing to signs. Let me show you guys what they're pointing to. They're pointing to these. Staff in this area. Right beyond this. Right, this is what they're pointing to. This is not the same thing. Because these signages Where are Where is the signages at? I saw them and then and then over here. Okay. There we go. So, yeah, it'll be good. It'll be good for him to learn a bit. Get a little educational. Where Where would I get a business card for this office? >> It's at the front desk. >> At the front? And then, do you guys have any um information? Like pamphlets, um resource lists, job lists that are open, like things like that. >> All of those resources are right there in the front. I don't appreciate being filmed. >> Ma'am, I'm just doing a story on this. >> telling you I don't appreciate being filmed. Take your >> to just give me your the card, I can walk away from you. I'm not >> your camera off of me. >> Ma'am, I'm here for a card like your boss asked you to do. If you give me a card, I can move. Okay? Thank you. >> I am not doing that. Please get your camera off of me. >> Look, this thing follows me. Where I turn, it goes. Okay? So, it's going to follow. >> I don't feel comfortable. >> it on me. I'm fine with that if you need to. >> I mean, I just need a card. >> She's just asking you not to. >> Right. But, we work for the public and I'm doing a story and that's pretty much that. So, perfect. Thank you. Okay, that didn't have to take that long at all. All right, let's grab this. I will have it. >> First thing is information on our services. >> You got some more? Cool. Awesome. Uh is this the same thing? I just need one. I'll probably throw that one away. >> Well, one's in Spanish. >> Oh, got you. Yes, I do have a lot of Spanish viewers. Yeah. Did you guys get the information you were looking for? No, people here are grumpy. Not very personable. >> I don't appreciate you filming in this state office. You don't have my permission. >> Well, I don't need it. I don't need I don't need it. You No, no, I don't. You're completely wrong. No, I don't. >> Look at the laws. >> I know I know them like the back of my hand. I do this with my freedom on the line daily. So, [clears throat] I know that. >> You're violating my freedom. >> No, I'm not, ma'am. You're a public servant that works for the public. I have every right and the Supreme Court disagrees with you. So. I don't. And I don't carry a card on me. >> Okay, what's your name? >> I don't give it. I'm anonymous. It would It could compromise what my story, so. >> Okay. >> Yeah, I don't give that information. But you guys will see it when it comes out. >> Okay, well. Thank you. >> Cool. No problem. This is um insane. These people are completely unprofessional, causing a huge problem and for no reason. It is a state office, like they said, and I think the Supreme Court knows more than this lady in front of me about what's actually a constitutional right and what's not. But when people are in a situation that they don't like, they just start making happens all the time. Well, we'll find out. All right? You'll You'll find out, I'm sure. So, we're taking more pictures and videos. Ma'am, don't get rid of that. I'm going to um request it before I leave here, okay? >> You have to submit a public records request to get any kind >> Oh, trust me. I know how to do it. >> It's fine. I'm just trying to get your picture. >> Okay. Well, I'm just taking yours. >> Okay. >> They got one. >> Okay, thank you. >> There they go. You can have all you want. It's not going to help you. I'm all over the internet. I'm not hard to find. Holy Okay, let's get that. Like I said, this happens when people aren't trained. They don't understand your rights and their position as public servants. That's the part of the biggest thing about it, right? When you're working as a public servant, you do not have a reasonable expectation of privacy. Yeah, now this is this is interesting. They have all these people back here. They're just running around watching me for some reason. Is that a working There is like almost nobody up in here if you guys paid So, how do I get help here? Knock knock or what? Somebody working up front? >> I'm going to tell you to put that camera away. >> Well, I need to do a public records request. You can refuse it. You don't have Ma'am, you don't have confidentiality you work here, but It is not against the law. You guys have already called the police and they told you you're wrong. That's why they're not here. So, I'm trying to do a public records request. If you refuse it, you can open the state up to a lawsuit, but it'd be a bad idea. My lawyers will eat that up, so All right, at least what I'm doing. >> Oh, here we go with the fake music. Play music, it'll mess this video up. Not true. >> [laughter] >> Let me talk to their boss who probably knows that they have to do a public records request, so Yeah, we'll not deal with the lesser employees who don't know what they're doing. Excuse me, ma'am. I'm trying to do a public records request. Your employees aren't helping me. Uh this is state law, and um so I need to request some records from you guys. If you guys choose not to help you, we'll open up the state to a lawsuit. It'd be a pretty bad idea, so. >> If you give me your information, I can send you the >> Yeah, I have Yeah, I'm I understand I know the law and I know the way it works. I'm I'm trying to follow your records request, so. >> Do you have your information so I could send you the link to follow for that? >> Oh, no, no, you don't need my information. I'm trying to do it in person. So, we can submit it written or verbal. I'm doing it verbally. So, it's written in the law. So, I'm going to do it verbally. You guys will write down what I want. You'll have 5 days to respond like the law says. >> Okay. You're You're requesting that, so you didn't give me information? >> Yeah, I'm going to I'm going to give you the the stuff that I'm looking for, yeah. >> Okay. What are you looking for? >> You ready? Okay, so um the young lady up front that was yelling at me about my camera who gave me the card, I want her full name. >> You're requesting information about our staff. >> Yeah, well, it's some of it is going to be about the staff, yeah. Some other parts are going to be about training. We're going to get the pictures and/or video you guys took. So, yeah. >> Requesting information about staff. >> No, the I want that specific lady's full name. I'm going to request specific information about her, you, your boss here, and some other people. So. >> Okay. >> So, it it has to be bullet pointed, and and it has to be written in the way I'm saying it. And it's going to be probably about 20 items. >> So, you're you're requesting information about the specific staff that you all have. >> Well, you saw who she was. I don't know her name, and so I >> You're giving that name to you guys? >> Well, it will be it will be in the records request. >> Okay. >> So, what I'm saying is I want her full name. So, that's number one, her full name, whoever she is. If you guys don't want to give me the name, I'll get it through a records request. It doesn't matter. I want her salary. I'm antagonizing by asking for a records request? >> No, we're taking your information. >> Uh uh who's she calling? Somebody to to start a problem? >> on our computers where your phone is facing. So, you do need to turn your phone away from our computer. >> Well, if I'm in a public area where I can be I can be I can look anywhere. Ma'am, can you just stop yelling and freaking out? Okay? Yeah, she is. What do you call this? >> Diana, the information that she's that you're needing. >> What do you What do you What do you call this? If If I can't be in this area, I'm glad I'll gladly stand over here, but I feel like I can't, so. >> That's private information. So, that we can provide you with the details that you're asking, but we need to collect the information. >> You're a customer? >> Can I ask you why you're recording this? >> Yeah, I'm doing a story. But if you don't work here, I'm not not interested in speaking with you. >> know, a bunch of ladies just got up and called for me and our protocol is to stand up and move. >> I mean, it's it is cool to do a story. I'm a journalist, right? Like they >> back this area usually. >> Well, I just told them I'm doing a records request. We can come out here, so. But it it's it's it's all good, man. I understand people being uncomfortable, but Well, got all kind of people yelling cuz the boss is not doing her job. I know that you guys called police and were told there's nothing we can do. You should control your employees in the situation before it gets out of hand. >> That's not what they said. >> Okay, well, if they come, they will. Anyways, um so her full name, her salary, a copy of her last two paychecks stubs, most recent from today's date. And just let me know when you're ready for the next one. >> Go ahead. >> Okay, I will take uh her um state-issued email address. I will take um >> The man in the last hour of the day. >> Oh, why don't you just keep it down so I can do my records request? Um There we go. Somebody just said freedom of speech, I love it. So um I'll take any and all emails sent or received by this office regarding my visit here today, and trust me, there's going to be a lot of them when I put this story out. And I'll take all that information for you as well. Everything I asked for from from her, I'll take it for you. And I'm assuming you're her boss. So you're boss as well, so you and your boss. Um I will take it from her here in the brown red shirt. I don't know her name. You might want to tell her, so. Oh, and the other gentleman, where is he? I can show his picture if I have to. I don't see him. I'll send an email about that. Did we get all that? Okay. Um I will take um any So, I'm going to give you an hour what's called and and both of you, so you can hear too. I'm giving you guys what's called a verbal litigation hold notice. Um any employee who took a video or pictures of me, you included with your phone, made a public record when they did that. I want a copy of those videos or pictures. Whether it's on your personal private phone, doesn't matter. If you do destroy them or erase them, it's a misdemeanor crime. And just so you know, I'm not I'm just one person here today, but I have 400,000 that are behind me and they'll ensure that you guys are held responsible for it, so. Um Yeah, so litigation hold is for any pictures, emails, trainings, memorandums, documents, anything regarding my visit here. Um and I think that's it. One, two, there was one, two, three, four. Yeah, four. Four people. Yeah, I'll I'll give you the contact. Are we ready? So, the the um contact info is @gmail.com. So, you guys can send a records request there. The response. And I'm sure you know, if you deal with them like you have 5 days to respond, but then you got there's an extension built in the law if you need more time to find the documents or whatever. So. Yeah, that's it for the records request. Yeah. Now, I'm going to snatch some water and pick some video and I'll be out of here. Please train your staff. This is a public place. It's >> a public place, but there is confidential information and people are not allowed to videotape because of that confidentiality for our customers. >> Yeah, you guys are wrong. I'm sorry. But, you'll you'll learn it. Like I said, when I put this video out, you guys will get training that you need. >> have the right to confidential information. Just like >> Right, but it's on you to >> that you have confidentiality. >> Well, I just said I'm private, but but the thing is is like it's the job >> our customers would have that same respect and right. >> Right, but I'm saying the job is yours to make that confidential. Like if I can walk by in a public area and see computers with confidential information, you have to keep it confidential. You see what I'm saying? And so, that's what I'm saying. But, one more thing to the records request, I want any trainings or memorandums put out by this office or the state of Oregon. You want me to slow down? Yeah, so any trainings or memorandums Yeah, yep. I'll get any trainings or memorandums put out by this office or the state of Oregon regarding members of the public exercising constitutionally protected rights while in this office. Cuz if you guys don't have one, I'm going to ensure you guys get the training so that this won't happen. Now, I I actually just did this with your Secretary of State the other day and who was very very open and clear and was like go to all our state offices. I want to know if somebody messes up so I can handle it. So, Cool. That's the last thing. Good. Okay. Cool. I'll hear from you guys in 5 days. All right, thank you. Oh, we got the rollos. Maybe I should talk to them. Let's see how many how much more time we got. We got 5 minutes. Let's let them Let's see if we can record the education. >> The store is closed. >> 1 minute. >> Cool. 1 minute. Huh, I thought you guys closed at 5. >> Yeah, 1 minute. >> Oh, Oh, that clock's wrong. >> [laughter] >> All good. Yeah, I I was hoping they would educate you real quick and I could catch it, but they'll they'll talk to you guys. >> How did you guys get >> Yeah, all good. >> Yeah. >> So, I get their pictures. Um, so it's fine. I'll come back tomorrow. Um, but clearly they just don't know, but like I said, maybe this um officer can supply an education and they can knock it off and stop being weird and all that good stuff. So, we'll see. But yeah, they'll get an education. So, this cop now is educating them um and letting them know unfortunately it I just came so late. It was 4:30. I kind of bounce back and forth from here and the DMV. Um, and uh look, now they're trying to he was here, he was there. He he could see this and no no, it wasn't public and blah blah blah blah blah. Look at them. We have signs that say you staff only. >> Now he's done. When he's done speaking to her, we're just going to let him hop out the door real quick and You can't leave. >> [laughter] >> Thank you. >> Thanks. Hey, buddy. But obviously these folks were just not happy about being recorded. Obviously. But like I discussed with them, this is a public sort of >> I seen you explaining it away. >> Yeah, and so forth. >> Yeah, I I I I know. I I know how it goes. I can only imagine how the conversation goes. Every time you told them they had a but he was this and but he was that and then you explain that and then I saw I watched the whole thing. Thank you. Appreciate it. >> Yeah, the the only the only caveat is if going into a bathroom uh something like that. >> Yeah, I don't need to know that. Yeah, I I didn't go I didn't go into a bathroom. I know what I can and can't do. Yeah, I know what I can and can't do. >> Okay. For sure. The only other thing is sometimes there's sensitive information on the computer screens like uh whether social security numbers um and stuff like that. So, inside the cubicles like filming of the screen, that's going to be >> No, no, I can do that. I can do that all day. I can film anything I can see from a public area. >> Yeah, yes. From a public area. What what I mean >> Including their screens. Yeah, and I didn't do that. I again, I know what I can and can't do. As a matter of fact, this could have been a whole lot worse, but I talked tried to talk all these people off the ledge while they're screaming and yelling, right? I could have just been there and it it I could have allowed it to get worse than it did and I just tried to teach and educate them. I know where I can and can't be. I never once stepped in a cubicle, right? They tried to show me some yellow signs in a cubicle to stuff only see. I'm like, I'm along the grout to the bathroom where you guys told me to go get water. So, it's it's they're they're just lost, but whatever it is what it is. That's why I record everything cuz people lie. >> Are you like a First Amendment auditor type? >> No, no, I was here for something totally different. >> Okay. >> Yep. >> All right, well, have a nice day. >> Cool, take care, man. So, um yeah, good job for for for him, you know, he did a good job. Nothing I can say bad about what he did. The deal with him in the conversation was better for the video than me standing out there catching everyone driving away. Um he's now out across the street over there sitting there for whatever reason. But, I seen him over here. Oh, what the All right, so this cop definitely went around the corner and came back over here. And he was sitting here looking for me. >> And now he's where? >> He's gone. What the No, so he's still there. Let's see what he's doing. So, he's running license plates. He's looking for my my plate. So, I thought he did a good job. Right now, he should have just left. There should be There should be no no um part of him that's running around searching
